Shelly Finkelstein is Co-Chair of the American Bar Association Litigation Section's Annual Meeting. It will be held in New York on April 21-23, 2010. The Annual Meeting features 50 programs in 12 tracks with panelists composed of leading judges, professors and practitioners from around the United States. They will discuss the latest issues in the law. Greg Miller will be a panelist on a program entitled "The Ethics of Web 2.0." Richard Chattman and Greg Miller published an article entitled "Measuring Business Interruption Loss in Wide-Impact Catastrophes: Insurance Against Catastrophes or Only Against Insured Damage from Catastrophes?" in the July/August 2009 issue of Coverage, a publication of the Committee on Insurance Coverage Litigation of the Litigation Section of the American Bar Association.

Hank Catenacci, Rob McGuire and Maureen O'Brien recently secured from the United States Court of Appeals for the Fifth Circuit an affirmance of the trial court's dismissal with prejudice of plaintiff's suit against property insurer Affiliated FM Insurance Company.

The program, "Don Giovanni: The Class Action," featured a federal jurist and the "testimony" of five opera singers as the panel explored an open issue under Federal Rule 23 class action practice. Stories about the program were featured in both The New York Times and The International Herald Tribune.
Shelly Finkelstein co-authored "Admissibility of Electronically Stored Information: It's Still the Same Old Story," which appeared in the Spring 2008 edition of Litigation, the Journal of ABA's Section of Litigation. The article analyzes recent case law developments and the application of the Federal Rules of Evidence to the admissibility of evidence derived from electronic discovery.
Shelly Finkelstein and Rob McGuire have authored a chapter on "Special Considerations in Cases Involving Civil Rico" in the recently-updated edition of New Jersey Federal Civil Procedure.
Shelly Finkelstein has authored an article, "Verga v. Mascagni and Sonzogno: An Operatic Litigation in Ten Acts," which appears in the Winter edition of Litigation, the Journal of ABA's Section of Litigation. The article analyzes the development of intellectual property law in Italy in the 1890s based on extended litigation arising from the creation of Cavalleria Rusticana, featured in the movie Godfather III.
Shelly Finkelstein co-authored the written materials regarding electronic discovery and document retention used at the Annual Meeting of the ABA's Committee on Corporate Counsel on February 16, 2008. These materials, entitled "Electronically Stored Information: Are You Ready?" are available on request.

Shelly has co-authored articles published in the ABA's Litigation dealing with electronic discovery issues, including, "Spoliation, or Please Don't Leave the Cake Out in the Rain," Summer 2006, and "A Primer on E*vide*n.c.e.," Winter 2002. Several of Shelly's articles appear in The Litigation Manual (3d ed.), recently published by the American Bar Association, Section of Litigation. Shelly has been appointed by the American Bar Association's Litigation Section to serve as a Co-Director of its Division V (Substantive Committees) for the bar year 2007-2008. Previously, Shelly served as Co-Director of Division IV (Procedural Committees) and Division VII (Task Forces).
